The purpose of Mesflacons.com is the sale of second-hand miniature perfume bottles and the promotion of perfume bottle collecting (lécythiophilie).
Customers and users are advised that the samples and miniatures we offer are for collection purposes. Unless otherwise stated, these are small products with low volume. These products were not given to us; we purchased them to offer to you, either directly from the perfume manufacturers or their wholesalers, or through the purchase of lots or collections from private individuals.
All products we offer are original, including the content (perfume, Eau de Cologne, Eau de parfum, Eau de toilette, etc.) they may contain. However, many of them are old and the juice inside may be expired; we advise against using them as a perfuming product.
Some may be second-hand, sometimes empty, without a box, or have defects; these specific characteristics are indicated in the description.
We sell collector's miniatures or samples. Some products may bear a label such as "Vente interdite" or "Not for sale".
These terms and conditions are intended for a consumer who has full legal capacity. These terms apply to all orders placed on this site.
We do our utmost to satisfy you. On this site, we present all the essential characteristics of the goods. We will pay attention to any comments you send us (in the "contact us" section).
We place the utmost importance on your security and satisfaction; in this regard, we commit ourselves far beyond legal obligations. These additional commitments are indicated in these terms by the phrase "Satisfaction Guarantee". These commitments are binding on us just as if they were written into law.

1 The different stages to follow for concluding the contract online
1.1 Ordering
You make your selection by browsing the pages of our site. Your selections are added to your cart when you click "add this product to the cart". At any time during your browsing on our site, you can confirm your order by clicking "validate my order".

Perfume miniatures and associated products are by nature ephemeral items for which we generally have no possibility of restocking. These are collector's items for which we generally only have one unique copy available.
Satisfaction Guarantee: We do not make automatic replacements. In the event that a product is out of stock, we will refund you directly to your PayPal account without you needing to request it. For customers who paid by check or bank transfer, we offer a choice between a refund in the form of a credit or a check.
1.3 Technical means for identifying and correcting errors
You have the ability at any time to identify and correct errors made when entering your data. When you notice an error after the contract has been concluded, you must contact us (in the "contact us" section). In the event of an error on your part resulting in an impossible delivery, the package will be shipped to you a second time at your expense after its return to our premises (which may cause a significant delay).
2 Archiving and access to the contract
We will archive contracts, order forms, and invoices on a reliable and durable medium.
You have a right of access to these documents for orders with an amount greater than or equal to €120.
3 Legal and contractual warranties
3.1 Legal warranties
In accordance with the legal provisions in force regarding the conformity of the good to the contract, in terms of hidden defects, we will refund or exchange any product that is apparently defective, damaged, or does not correspond to your order.
We will also refund all return costs upon simple presentation of proof.
In the event of a return for non-conformity, please return the entire order, including any gifts, and take care to send it back in its original state in suitable packaging.
Upon delivery, without this constituting a challenge to the benefit of legal warranties, we ask you to verify the apparent condition of the products in the presence of the delivery person (written reservation notation, completion of an "anomaly report" at La Poste).

3.3 Limitation of liability
We do our utmost to satisfy you. We are responsible for the proper execution of these general terms and conditions. Nevertheless, our liability cannot be engaged due to an unforeseen event, a case of force majeure, the unforeseeable and insurmountable act of a third party to the contract, or the non-conformity of the product with foreign legislation in the case of delivery to a country other than France.
Satisfaction Guarantee: This limitation of liability does not apply to legal warranties, liability for defective products, or failure to deliver. Furthermore, even in the above cases, we will try to do our best to accommodate you.
4 Delivery times, costs, and methods
4.1 Delivery methods
We will deliver the products to the address indicated in the order form.
4.2 Delivery time
We send your package no later than one week after actual receipt of your payment. The delivery time is then approximately 48 hours for metropolitan France and can be up to 15 days for other geographical areas.
Satisfaction Guarantee: In the majority of cases, we send your package within 48 hours; during busy periods, we sometimes indicate a deadline for ordering to ensure delivery before [Christmas, Mother's Day...]. If your order is not delivered within 7 days from the deadlines provided above, you have the option to cancel it.
4.3 Delivery costs
Delivery costs are indicated on the corresponding page which serves as an appendix to this contract. They are explicitly mentioned during the ordering process.
Reminder: any customs fees are not delivery costs; you are responsible for paying them depending on the country where you request delivery. Since our company is a company under French law, you do not have to pay customs duties for metropolitan France or for member countries of the European Union.

5 Price
Our product prices are indicated in euros including all taxes (French VAT and other applicable taxes).
If you request delivery outside of metropolitan France, your order may be subject to potential taxes and customs duties upon arrival at its destination.
The payment of these duties and taxes is your responsibility, and we invite you to inquire with the competent authorities of your country. You must also verify the possibilities of importing or using the products you order from us in the destination country.
6 Payment methods and security measures
Satisfaction Guarantee: When possible, we do not cash your payment until the moment of actual preparation of the package.

The first two will suit the vast majority of cases; payment by check is recommended for French customers who do not want to pay online or wish to pay in three installments. Finally, bank transfer is well suited for large orders from abroad.

By check or in three checks without fees (France only).
If you prefer not to pay online, you have the option to pay by check; you just need to choose this option during payment.
Be sure to complete the procedure; you will receive a message with our full details for shipping and the payee for the check.
Then send your payment by standard mail with the references or a copy of your order.
IMPORTANT: your check must be made out in euros and payable to a French bank.

To benefit from this, you just need to send us 3 checks of an amount equivalent to the total of your order.

7 Satisfied or refunded: procedures for exercising the right of withdrawal
In accordance with legal provisions, within 14 days following the receipt of your product, you can exercise your right of withdrawal. You do not have to provide reasons or pay a penalty. With the exception of return costs, which remain your responsibility, we will refund all sums paid no later than 30 days after your withdrawal. Upon our proposal, you may also opt for another method of reimbursement.

8 Duration of the contract and validity of the price.
Prices take into account the VAT applicable on the day of the order, and any change in the applicable VAT rate will be automatically reflected in the price of the products for sale on the site.
The products remain the full property of Perfume Collection Miniature until full payment is received.
Our price offers are valid only within the double limit of the validity period of the offer concerned and available stocks.
Our offers of goods and prices are valid if they appear online on the site on the day of the order.

9 Applicable legislation/ Competent jurisdiction
